Please note, As we provide a service we accept no returns on all of our made-to-order swimwear (unless eligible under our faulty order, incorrect order and T&Cs). All of these designs are produced via a made-to-order service, with each garment being sewn in house upon the customer’s request. We provide In-depth information regarding each design, fabric, colours and imagery that is all easily accessible to view online.
We highly recommend all customers to check their order is correct before finalising, as the customer is liable for each selection made on their order.
Please shop carefully as we do not accept returns for the following:
• Any Made-to-order Swimwear
• In-stock Swimwear if the hygiene seal has been broken or removed.
• Final Sale items or Pierced Jewellery.
• Items purchased during a sitewide sale of 30% off or more.
If the item you are returning is not any of the above, your return will only be accepted if:
• Your return is received by us within 14 days of delivery (UK customers) or 30 days (international customers).
• The returned item is in its original sellable condition ie. it is unworn, unwashed, unmarked and has all tags/ hygiene labels attached; and
• The item does not have any fake tan, makeup or deodorant marks on it, even if only tried on.

All parcels are sent via Royal Mail Post. Once each parcel is dispatched from the Mermaids Swimwear studio, you will receive an email confirmation which includes tracking information to the email address used to place your order, if for some reason you did not receive an email, please check your spam folder and add info@mermaids-swimwear.com to your safe list.
We do not deliver to PO Boxes/Parcel Lockers. If you enter a PO Box address, your order will be held and we will contact you for an alternative address. If we don’t hear from you within 48 hours of contacting you, your order will be canceled and refunded.

We are not responsible for delays incurred by our credit card verification process, incorrectly provided addresses, external factors impacting our shipping couriers, custom holds or any other circumstances beyond our control.
**Currency conversions are estimates only and the total amount you are charged will depend on the exchange rate and processing fees your bank charges you. Your order will be processed in GBP and the conversion rate will be decided by your bank.

We make every effort to ensure all orders received are shipped the following business day, except during busy sale periods or unforeseeable circumstances beyond our control when orders can additional days to be processed before they are shipped.

Please allow between 2-4 Weeks for any orders made from our Made-to-order collections (More specific time frames per style are advised on the product). We aim to make every effort to ensure all orders are completed ASAP but please be mindful of the timeframe suggested during busy periods and ensure you are leaving plenty of time to order in time for your trip! This time frame does not include shipping.
CHANGES TO ORDERS/CANCELLING PRE-ORDERS
Once orders have been placed we are unable to make any amendments to orders. This includes combining orders, adding pieces to existing orders or changing the delivery address. Please carefully check your billing and shipping information before you place your order as our dispatch team processes orders quickly and we are unable to make changes to orders once they are shipped. We are also not able to cancel any orders for pre-order styles as these orders are sent to our suppliers immediately after your order is placed.
SHIPPING DELAYS DURING SALE PERIODS & PUBLIC HOLIDAYS
Due to the huge response we receive during sale and promotional periods, there are times where we will be unable to ship your order the following business day. Please allow additional days for the processing of your order during these sale times, as well as any public holidays when the studio is closed.
INTERNATIONAL TAXES & DUTIES
Please note that the price you pay for your order online with us does not include possible taxes and duties which may be applied by customs authorities when your parcel is received into your country. This is a separate charge and is unrelated to us. The knowledge and payment of taxes and duties are your responsibility and you should look these up before purchasing if you are worried about these additional costs. For more information on what duties and taxes may be payable by you prior to the delivery of your parcel, we recommend checking your local customs website or giving them a call for more information.
CUSTOMS HOLDS
Estimated delivery times do not include customs delays or holds. In the unlikely event that you have not received your parcel within a delivery time estimated above and you have not been contacted regarding your delivery by one of our shipping couriers, please get in touch with us via our Contact Us page and we will investigate your delivery on your behalf.

All contracts and dealings between Mermaids Swimwear and each of its subsidiaries, affiliates, associated companies, related entities, successors/parent company and assigns (‘Mermaids Swimwear’) and any person (‘Customer’) relating to any goods or services (‘Goods’ and ‘Services’) provided and supplied by Mermaids to the Customer through the website mermaids-swimwear.com. (‘Website’) are subject to the terms and conditions of trade set out below (‘these Terms’).
By using the Website, the Customer agrees to be bound by these Terms, as may be amended by Mermaids Swimwear at any given time.
V A R I A T I O N
Mermaids Swimwear has the right to amend, remove or vary these Terms at any time without notice. It is the Customer’s responsibility to be aware of any changes made to these Terms and by continuing to use and visit the Website the Customer agrees to be governed by these Terms as the case may be from time to time.

Access to the Website is permitted on a temporary basis, and Mermaids Swimwear reserves the right to withdraw or amend the Services without notice. Mermaids will not be liable if for any reason the Website is unavailable at any time or for any period. From time to time, Mermaids Swimwear may restrict access to some parts or all of the Website without notice.

• All intellectual property rights in all software and content made available to the Customer on or through the Website remains the property of Mermaids Swimwear.

• The Customer is not permitted to copy, reproduce, alter, distribute, publish or use in any manner any content on the Website other than as permitted under these Terms without the written express consent of Mermaids Swimwear. Such consent may be withheld by Mermaids Swimwear at its absolute discretion.
• The Customer must not remove any copyright or trademark notices from the content found on the Website.
• Mermaids Swimwear makes no representation or warranty to the Customer of any kind, express or implied that the Goods and Services will not infringe any intellectual property rights of a third party.
T E R M S O F S A L E
• By placing an order for any Goods on the Website (‘Order’) the Customer is offering to purchase the Goods on and subject to these Terms. Each Order the Customer places will be a separate and binding agreement between the Customer and Mermaids Swimwear with respect to the supply of the Goods in accordance with these Terms.
• All Orders are subject to availability of the Goods and confirmation of the Order price.
• Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to UK and are intended as an estimate only and are subject to any delays resulting from postal delays or force majeure (see clause 15) for which Mermaids Swimwear will not be responsible.
• The Customer acknowledges that all Orders through the Website are with respect to goods intended for personal and domestic use only and non-commercial use.
• Mermaids Swimwear reserves the right to accept or reject an Order for any reason at any time.
• When placing an Order the Customer undertakes that all details that are provided to Mermaids Swimwear are true and accurate, that the Customer is an authorised user of the credit or debit card used to place the Order and that there are sufficient funds to cover the cost of the Goods
P R I C E
• The price with respect to any Goods is specified on the Website (‘Price’). The Price is exclusive of any delivery fee (see clause 10).
• Unless otherwise stated, all Prices quoted are in British Pounds and where applicable are exclusive of goods and services tax (‘GST’). Any fees and charges (e.g. delivery fees) imposed by these Terms also exclude GST where applicable.
• Mermaids Swimwear reserves the right to change or alter the Prices of Goods on the Website without notice to the Customer, unless the Customer has submitted an Order at a stipulated Price, in which case there will be no change or alteration in pricing.
• In paying or attempting to pay for the Goods, the Customer agrees that the Customer has not engaged in any fraudulent conduct or contravened any law.
• Mermaids Swimwear will issue the Customer with a tax invoice once payment in respect of the Order has been processed.
C A N C E L L A T I O N, R E F U N D & E X C H A N G E P O L I C Y
• Unless provided for under these Terms, no cancellations or changes to Orders will be accepted, and the Goods will be delivered to the stated delivery address in accordance with these Terms. Therefore, the Customer should carefully check that its Order is accurate before the Customer submits it to Mermaids Swimwear. The Customer will, however, be able to return selected Goods in accordance with Mermaids returns policy.
• Mermaids Swimwear may accept returns within 14 days for UKcustomers and 30 days for international customers from the date of delivery. Goods must be unwashed, unworn and in their original purchase condition with original tags still attached with no signs of being removed and re-attached.
• Goods for return must be posted at the Customer’s expense.
• The Customer must fill out the returns request form in order for us to process all returns.
• Any Goods which Mermaids Swimwear has elected to accept for either return shall be returned at the Customer’s expense. The Customer will not be refunded for the original postage cost unless the garment was faulty, or there was a dispatch error by Mermaids Swimwear.
• Made to order swimwear items cannot be returned unless deemed faulty or wrongly described as defined under the UK Consumer Law.
D A M A G E D & F A U L T Y G O O D S
• All Goods are thoroughly inspected to ensure they are in a sellable condition prior to being sent to the Customer. All Goods come with guarantees that comply with UK Consumer Law.
• If the Customer discovers that a Good is faulty or damaged, the Customer must notify Mermaids Swimwear within 14 days of purchase by contacting Mermaids Swimwear via our contact page online.
• If Mermaids inspects the Goods and confirms that there is a fault, the Customer will be entitled to either a repair or replacement (for a minor fault) or a refund, repair or replacement (a major fault). The UK Consumer Law Guarantees outline the difference between the two. See here for more information.
• Mermaids Swimwear will cover the packaging and postage costs associated with the Customer returning a faulty or damaged Good.
• Customers are liable for any delivery costs if the Good is found not to be faulty.
D E L I V E R Y
• Any period or date for delivery of Goods stated by Mermaids Swimwear is intended as an estimate only and is not a contractual commitment. Mermaids will use its best endeavours to meet any estimate delivery dates but will not be liable for any loss or damage suffered by the Customer or any other person for failure to meet an estimated delivery date.
• Mermaids Swimwear reserves the right to amend delivery methods without notice.

• All deliveries of Goods purchased by the Customer will be made by registered courier (Royal Mail) and are delivered requiring a signature at the delivery address.
• If the Customer believes their nominated delivery address will be unattended at the time of delivery, Tiger Mist suggests nominating an address that the Customer knows will be attended during regular business hours. If the nominated delivery address is unattended at the time of delivery, a card will be left with details as to where the Customer can collect the Goods or arrange a re-delivery.
• Mermaids Swimwear will not be held responsible for any occurrence that may happen following the Delivery of a Goods, including theft or damage. All risk in the Goods will remain with the Customer upon Delivery and Mermaids Swimwear will not offer a replacement Good or refund a Customer for any lost or damaged Goods.
• Mermaids Swimwear will use reasonable endeavours to dispatch all Orders received on the same day before 12pm, or the next business day after this cut off point. Estimated delivery time depends on the Customer’s location. Shipping times on the shipping information page are to be taken as an estimate only.
• Delivery of Orders placed on a weekend or public holiday will not be processed until the following 1-2 business days.

• International deliveries will be made by Registered Post or Pack & Track (via Royal Mail Post).
• Estimated delivery time for international orders varies depending on location.
• In the event the Customer does not receive their Order within 15 business days of placement, the Customer should contact Mermaids Swimwear.
• International delivery costs do not include any taxes or duties which may be applied by customs at the destination country. Any duties or taxes incurred are the responsibility of the delivery recipient. Mermaids Swimwear has no control over the import fee charged and will not be responsible for the payment of any duties or taxes.
• Where taxes and duties are refused to be paid by a Customer and a parcel is returned to Mermaids Swimwear , the Order will be refunded (less any shipping costs paid).
P R E – O R D E R I T E M S
A Pre-Order is the term used when a Good is currently unavailable for immediate shipment and is in production to be shipped at a later date. The estimated date of delivery is displayed on the product page and the product is clearly marked as a pre-order online. Pre-Order items that are not able to be cancelled once placed.
L I M I T A T I O N O F L I A B I L I T Y & I N D E M N I T Y
• The UK Consumer Law guarantees certain conditions, warranties and undertakings, and gives the Customer other legal rights, in relation to the quality and fitness for purpose of consumer goods sold in UK. These guarantees cannot be modified nor excluded by any contract. Nothing in these Terms purports to modify or exclude the conditions, warranties, guarantees and undertakings, and other legal rights, under the UK Consumer Law and other laws which cannot be modified or excluded. Except as expressly set out in these Terms and the UK Consumer Law, Mermaids Swimwear makes no warranties or other representations in relation to the supply of Goods. Mermaids Swimwear’s liability in respect of these warranties, representations, undertakings and guarantees is limited to the fullest extent permitted by law.
• The Customer agrees to use the Website at their own risk. The Customer agrees to indemnify Mermaids Swimwear, its affiliates, officers or directors from any third party claims, liability, damages and/or costs arising from the Customer’s use of the Website or breach of these Terms, including damages caused by virus or any incorrectness or incompleteness of the information on the Website or the supply or use of the Goods.
• Mermaids Swimwear does not accept responsibility for any loss or other detriment arising by reason of any theft, loss or damage to, or otherwise concerning any property belonging to the Customer.
• Further to clause 3, the Customer accepts upon Delivery all risk for loss or damage to the Goods whether caused by the Customer or not, and the Customer indemnifies Mermaids Swimwear against all claims, demands, suits and actions for loss or damage caused by or arising from the handling, transport, storage, display, installation, neglect or use of the Goods after the Customer has taken possession of the Goods. Risk in the Goods will remain with the Customer at all times unless Mermaids Swimwear retakes possession of the Goods in accordance with clause 9.

• The Website may provide links to websites and access to content from third parties, including users and affiliates of Mermaids Swimwear.
• The Customer agrees that Mermaids Swimwear is not responsible for the availability of, and content provided on, third party websites. The Customer should refer to the policies posted by other websites regarding privacy and other topics before they use them.
• To the fullest extent permitted by law in no way will Mermaids Swimwear, its officers, agents and employees be held liable for any remedy at law or in equity for any loss or damage incurred from dealing with any third party.

• The failure of a party at any time to require any performance by another party of a provision of these Terms shall not affect in any way the full right of the waiving party to require that performance subsequently.
• The waiver by any party of a breach of a provision shall not be deemed a waiver of all or part of that provision or any other provision or of the right of that party to avail itself of its rights subsequently.
• Any waiver of a breach of these Terms shall be in writing signed by the party granting the waiver, and shall be effective only to the extent specifically set out in that waiver.
F O R C E M A J E U R E
If the performance of Mermaids’s obligations under these Terms is prevented, restricted or affected by a force majeure including strike, lock out, raw material shortage, breakdown of plant, transport or equipment or any other cause beyond the reasonable control of Mermaids Swimwear , Mermaids Swimwear will not be liable for any loss or damage suffered by the Customer or any other person and Mermaids Swimwear will give the Customer written notice if the force majeure event has continued unabated for 30 days.
S E V E R A B I L I T Y
• The parties agree that all the provisions of these Terms are reasonable in all the circumstances and that each provision is and shall be deemed to be severable and independent.
• The parties agree that if part or all of any one or more provisions are judged invalid or unenforceable in all the circumstances, that portion shall be deemed to be deleted and shall not affect the validity or enforceability of the remaining provisions.
E N T I R E A G R E E M E N T
These Terms constitute the entire agreement between the parties as to its subject matter and supersedes and cancels all prior agreements, understandings and negotiations in connection with it and may only be altered in writing signed by all parties.
Mermaids Swimwear is committed to protecting the privacy of any information provided by its Customers and will take all reasonable precautions to protect personally identifiable information from loss, misuse or unauthorised access.
In dealing with a Customer’s personal information, Mermaids Swimwear will fulfil all obligations under the Privacy Act 1988 (Cth) and the National Privacy Principles.
In order to process a Customer’s Order, Mermaids Swimwear requires information such as the Customer’s name, email address, contact number, delivery address and payment details.
Mermaids Swimwear will not sell the Customer’s personal information to any third party.
Mermaids Swimwear will not disclose the Customer’s details to any third parties without the Customer’s consent except in the following circumstances:
• For delivery purposes; and
• If necessary to comply with applicable laws, investigations, or legal proceedings where Mermaids Swimwear is obliged to disclose the Customer information.
For transaction security for credit card payments, Mermaids Swimwear uses WordPress certified partner Stripe. No human intervention is required to complete this credit card transaction and credit card details are discarded once processed at point of purchase.
Mermaids Swimwear uses browser cookies to recognise the Customer on the Customer’s return visit and to measure website traffic. The Customer can disable this feature on their browser.
Mermaids Swimwear does not currently require its Customers to register in order to access the website, but reserves the right to do so in the future. Should Mermaids Swimwear implement a registration process, Mermaids Swimwear will commit to comply with any privacy legislation applicable at the time in respect of the Customer’s user information.
From time to time it may be necessary for Mermaids Swimwear to revise its privacy policy. Mermaids Swimwear reserves the right to change its privacy policy at any time without prior notice. Mermaids Swimwear will notify the Customer of any significant changes by posting an updated version of the policy on the Website.
By using the Mermaids Swimwear website the Customer is consenting to the collection of information by www.mermaids-swimwear.com in accordance with this Privacy Policy.
